Ano ang Mali sa Dengvaxia Report ni Gordon?

Naglabas na ng report ang one-man team ng Senate Committee on Justice.

Selective Evidence, Sabi ni Senator Drilon

 

Mga puntos na inilahad ni Senator Franklin Drilon sa 30-page dissenting vote nya tungkol sa Dengvaxia:

  • Base sa PGH Investigative Task Force Investigation at sa statement ni Dr. Scott Halstead na isang dengue expert, sinabi ni Drilon sa kanyang dissenting vote na, “We found no conclusive scientific evidence to support the conclusion that any of the reported deaths were in any way connected to Dengvaxia.”
  • Ayon din kay Drilon, “Declaring certain personalities guilty at this point would not only be premature but would also reinforce impressions of the politicization of a legitimate public health concern that must be addressed in a clinical manner.”
  • Ganun din, sinabi ni Drilon na ipinatupad din ng rehimeng Duterte ang dengue vaccination. 400,000 nga raw ang nainiksyunan sa ilalim ng rehimeng Duterte at 280,000 kids naman sa ilalim ng rehimeng Aquino. Ngunit, hindi isinama ni Gordon si dating DOH Secretary Paulyn Ubial sa mga dapat kasuhan samantalang ipinatupad din naman ng huli ang vaccination program.
  • Kinuwestyon din ni Drilon ang paggamit ng felony doctrine sa Garcia v. People, kung saan nag-rule ang Supreme Court na ang taong nakagawa ng mabigat na kasalanan ay responsable sa lahat ng consequences, maging natural o logical, dahil sa kasalanang ito.

 

Ayon kay Senator Drilon, hindi ito nag-aapply sa kaso ni Noynoy Aquino dahil hindi present ang lahat ng elements: malice, intentional felony, at ang resulta o kamalian ay isang direct, natural, at logical consequence ng felony act. In good faith ang desisyon ng dating Pangulo.

 

Ayon din sa Senador, “The first element that an intentional felony was committed is conspicuously absent. It is clear that President Aquino did not act with malice or dolo in procuring the vaccine.”

 

Hindi rin daw alam ni Noynoy ang posibleng epekto ng vaccine sa mga seronegatives dahil wala namang ebidensya ang ill effects nito noong binili ang Dengvaxia vaccine.

  • Wala ring technical malversation of funds dahil nakapaloob sa constitutional authority ang paggamit ng savings para pondohan ang pagbili ng vaccine.
  • Wala rin daw undue haste sa pagbili ng Dengvaxia dahil ang pag-approve ng pagbili ng vaccine ay nakapaloob sa timeline na naaayon sa batas. Ang usapin ng problema sa dengue ay nagsimula noong 2010 at ang problema ay nag-exist ng ilang dekada na. Ang pagbili ng Dengvaxia noong 2015 ay hindi pwedeng maituring na pagmamadali.

Isang Personal na Takap, Ayon kay Senator de Lima

 

Ayon kay Senator De Lima, isang “personal diatribe” o takap ang draft report ni Gordon laban sa dating Pangulo.

Sabi ng Senadora, “The Gordon Dengvaxia Report is not a legislative investigation report. It is Gordon’s personal political manifesto demonizing former President Benigno Aquino III and his administration.”

Dagdag pa ni De Lima, “The Blue Ribbon Committee Dengvaxia Report is Gordon’s personal diatribe against former President Aquino. Nothing more, nothing less.”

Hindi raw binigyan ng halaga ang mga testimonya at ebidensya na iniharap ni Noynoy at mga opisyales nito. Sabi nya, “It is as if PNoy and his officials were never there at the Blue Ribbon Committee hearings.”

Hindi Pipirmahan ni Senator Lacson ang Dengvaxia Report

 

Hindi pipirmahan ni Senator Ping Lacson ang draft committee report dahil sa “unreasonable” comments ni Senator Gordon laban sa kanya. Sinabi kasi ng huli na hindi sya magugulat kung against sa kanyang report si Lacson dahil kaibigan daw ng huli si Noynoy.

Ayon sa text message ni Lacson, “While I did not attend a single hearing on Dengvaxia for obvious reason shared by most of my colleagues, I was closely monitoring the proceedings in my office. Having said that, even that early I had my reservations based on his prejudgment which was too obvious to ignore. He (Gordon) was directing the investigation to suit the outcome that he had desired from the very start.”

Isang Publicity Stunt Lamang, Ayon kay Senator Trillanes

 

Ayon sa ANC interview ni Senator Trillanes, “The malice and the obvious conspiracy is only in the mind of Mr. Gordon. It is an obvious publicity stunt to smear the name of President Aquino. It is political harassment. These things are happening within context of Chief Justice (Maria Lourdes) Sereno under fire and Senator (Leila) De Lima in jail right now and myself a subject of political harassment. All of these are part of the big picture. It cannot be taken in isolation.”

Dagdag pa ng Senador, “It won’t even reach to that point that it will be voted on. I don’t think it will pass the period of interpellation, it will not stand the scrutiny of the senators.”

Wala Pang Napapatunayang Namatay na Bata dahil sa Dengvaxia, Ayon kay Senator Bam Aquino

 

Sabi ni Senator Bam Aquino, “Though this report has not been made available to the members of the Blue Ribbon Committee, if the final report reflects yesterday’s statements and political leanings, we will have serious concerns with the conclusions made.”

Dagdag pa ni Senator Bam, “Ang isang mahalaga na lumabas sa presscon kahapon ay wala pang napatutunayan na may batang namatay dahil sa Dengvaxia vaccine [One thing is important that came out of that presscon yesterday and that no proof that a child died because of the Dengvaxia vaccine].”

Naging Politikal na ang Senate Investigation tungkol sa Dengvaxia, ayon kay Senator Risa Hontiveros

 

Nagulat na lamang si Senator Risa Hontiveros na isinapubliko ang isang unnumbered and unsigned Blue Ribbon committee report.

Tanong ni Senator Risa, “Ganyan na ba ngayon sa Senate Blue Ribbon Committee?”

Sabi ng Senadora, “Nakakalungkot at lalo tuloy bumibigat ang obserbasyon ng marami na nagiging politikal na ang imbestigasyong ito.”

Dagdag pa ni Risa, “I reserve my opinion on the accused individuals pending the release of the copies of the said report to the members of the committee.”

Sino-sinong Senador ang may “With Some Reservations” sa Dengvaxia Report ni Gordon

 

Senator Sonny Angara, “I expressed disagreement with the part of the committee report which sees the former president as criminally liable. I think a President should be able to reasonably rely on the advice given to him by health experts, so long as this advice is not patently unlawful or dangerous.”

Si Senator Ejercito ay pumirma rin sa report pero hindi sya sumasang-ayon na si Noynoy ay isa sa mga main conspirators.

Ayon naman kay Senator Sherwin Gatchalian, hindi sya kumbinsidong may criminal liability ang dating Pangulo, ngunit accountable ang huli sa dengue vaccination program.

Ayon kay Chiz Escudero, “I concurred as regards their findings and recommendations regarding Sanofi and DOH (Department of Health) but dissented in the inclusion of PNoy (Aquino’s nickname).”

May reservations din daw si Senator Grace Poe tungkol sa report ni Gordon.

Para naman kay Senator Nancy Binay, “Sa akin ‘yung committee report, it’s not yet the final report. I mean, pagdedebatehan at pag-uusapan pa ‘yan at ide-defend pa ‘yan sa floor. So hintayin na lang natin ‘yung magiging deliberation na magaganap sa floor.” Pero, pinirmahan ng senadora ang report ni Gordon.

Pumirma rin si Senator Ralph Recto. Ayon sa kanyang paliwanag, “I agree with many of its recommendations on moving forward. But I dissent on recommended liability of President Aquino.”
